OVERVIEW

Welcome to Kozaru Japanese Crafts! These Terms of Service ("Terms") govern your use of our website and purchase of products from Kozaru Japanese Crafts ("we", "us", "our"). Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - SCOPE AND CONTRACT PARTNER

By placing an order in our online store, you are entering into a contract with:

These Terms apply to all orders placed by consumers and businesses via our online store. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

SECTION 2 - CONCLUSION OF CONTRACT

The presentation of products in the online store does not constitute a legally binding offer, but a non-binding online catalog. By clicking the order button (e.g., "Buy now" or "Place order"), you place a binding order for the goods contained in the shopping cart.

Confirmation of the receipt of your order follows immediately after sending the order by automated email. This email confirmation does not yet constitute acceptance of the contract. We can accept your order by sending a separate order confirmation by email or by delivering the goods within 5 days.

SECTION 3 - PRICES AND PAYMENT

The prices stated on the product pages include the statutory value-added tax (VAT) and other price components. Shipping costs are not included in the purchase price and will be clearly displayed during the checkout process before you confirm your order.

SECTION 4 - DELIVERY AND SHIPPING CONDITIONS

Delivery is made within Germany and to other countries as specified on our website. Delivery times are estimates and are stated in the product description.

Important for consumers: The risk of accidental loss and accidental deterioration of the sold goods passes to you only when the goods are handed over to you or a person authorized by you to receive them. If you are a business customer, the risk passes to you as soon as we have delivered the goods to the carrier.

SECTION 5 - RIGHT OF WITHDRAWAL (CANCELLATION)

Consumers generally have a statutory right of withdrawal of 14 days. Details regarding the conditions, time limits, and procedures for exercising this right can be found in our Refund Policy.

SECTION 6 - RETENTION OF TITLE

The goods remain our property until full payment has been made.

SECTION 7 - WARRANTIES AND LIABILITY

7.1 Statutory Warranty Rights
For all goods from our shop, statutory warranty rights exist (Mängelhaftungsrecht). If the delivered goods are defective, you are entitled to the statutory rights (repair, replacement, reduction of price, or withdrawal from the contract).

7.2 Limitation of Liability
We are liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents:

  • in case of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of guarantee promises, if agreed, or
  • as far as the scope of the Product Liability Act is opened.

For breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contracting partner may regularly rely (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, liability shall be limited to the foreseeable damage that typically occurs at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

SECTION 8 - PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international or local regulations, rules, and laws; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

SECTION 9 - DISPUTE RESOLUTION

The European Commission provides a platform for Online Dispute Resolution (ODR), which you can find here: http://ec.europa.eu/consumers/odr/.
We are not obliged and generally unwilling to participate in dispute settlement proceedings before a consumer arbitration board.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The application of the UN Sales Convention (CISG) is excluded.
